You and your family are going on vacation and you plan on renting a car. Your 19 year old son will be going with you who, per the rental company’s contract, can not drive the vehicle unless he is 25 years or older. However during the course of the vacation, without giving it much thought, you ask your son to go to the store to get a couple things for dinner. On the way back the son is involved in an accident in which he is at fault. Will your personal auto policy provide liability coverage for damage to the rental car and the other party involved? The answer is no. It is very unlikely that the personal auto policy would respond because of specific exclusions within the policy. One is a Liability exclusion that says you can not use a vehicle without a reasonable belief that the insured is entitled to do so. The second is a Physical damage exclusion that says a loss to any non owned auto when used by you or any family member without a reasonable belief that your or that family member are entitled to do so is not covered. The solution here is to follow the agreement of the rental car company. You don’t want to find yourself in a claim situation that may not be covered and having to pay significant out of pocket expenses!
